UPDATE:: so it looks like we will not own this boat after all, after 6 weeks of dealing with a very difficult owner we have decided to cut our loses and get back on track to our original plan. After spending near $5k you could say I'm not pleased with this guy. If a seller would be honest upfront with things as simple as "his plans" or schedule instead of dragging someone along after he demanded a deposit to show our commitment it would have gone along way with us.
Well you live and learn so we're back to looking at other models we're considering 420DB 44DB now after thinking we'd probably not need a 3rd stateroom anyway (easy to say after loosing it) so the hunt continues. We have looked at 2 so far and 1 is worthy of an offer. I'm a little disappointed in the whole experience but it has prepared me for the next seller!!

Sorry to hear you wasted time and money... Most sellers are not that bad, after all you sold your boat and that went well... Take your time and the right boat will come along.
 
Sometimes these things are a blessing...I had a really bad experience that ironically forced me to look elsewhere and I got the perfert boat for us the very next day...in hindsite, glad it happened, but we were pretty upset during the process. Best of luck, you'll get the right boat soon.

I’m sorry this ended badly on this one. Like you said, live and learn and you ARE ready for the next seller. Unfortunately, there are bad sellers out there, but not all. After this experience, you know what you are willing to do to enter a deal and see it through, but more importantly, you know when it is going south.... You will find the “right” boat and deal, good luck! You can vent to us anytime!!!

Caveat Emptor. Shame that people can be sneaky, but sounds like it's a good thing that you did your due diligence. Good luck going forward!
 
Obviously, I am not a party to your negotiations on this deal, but we buy boats with a contract for purchase for a reason. Usually, it is to insure the buyer will complete the deal. In this case, if you were dealing with a broker or if you used a standard contract form from someone like Boat/US, then, if you want the boat and if you removed all of the contingencies you placed on the deal in a timely manner, you can sue the seller for specific performance under your contract and force him to complete the sale……and it doesn't make a rat's ass what his plans were/are or how they changed. With the right contract form in place, at a minimum, you should be able to recover all of your due diligence costs as agreed damages.

Guys thanks I wasn't looking for sympathy just wanted to update everyone here especially if A deal goes bad. I have had all the pros involved in our searches so far from CAPT.Rusty , Frank, And friends with similar models/motors so I'm trying to cover my a!! When it comes time to pull the trigger I appreciate all the help these guys are giving me Diesels are new to me and mant others here so I reached out for advice and was welcomed with a helping hand from Frank. So I listened to him and avoided a certain boat and moved on. This boat may come around again we don't know and when heads cool down maybe it will be done who knows ?
Alex said to me today " your buying their boat ! Not the people!" I may have another discussion with the admiral tonight since she really liked the boat but she's emotionally drained also from this ordeal ! For now thanks buddies!!!!
