Smok'n Hot 55 DA

If he was playing with fireworks on the boat, then the fire was set by the owner's action and the claim should be denied. OK?

The claim would not be denied as there is no stupidity exclusion on any policy that I am aware of. The only way they could deny that is if there is a fireworks exclusion on the policy, or if he had them on the boat with the intention of starting a fire on the boat.

Really? Well I should go set off some fireworks from Just Ducky this weekend. She's insured for about double her current market value. Maybe I'll get lucky. Hello diesels!:smt038

Best regards,
Frank

The above is correct,I work for a major insurance company as a damage adjuster and while there is no exclusion for stupidity, the carrier can reserve its rights to "investigate" the loss. This can sometimes take a while, and costs such as interest on loans is not a covered part of the loss.

I actually have a loss going on now where the inured was street racing a 100K sports car and lost it. Four months into the claim, we are no closer to resolution than day 1. Also, that policy had an exclusion for racing, but not stupidity !!!

Thank paisano. Now who's Frank going to sell Impluse III to?

If Fireworks were heard going off as the boat burned, I would think an insurance adjuster might have some issues here. But what do I know?

having issues and not paying claims are two different things. An insurance policy is a contract between the policy holder and the company. There are coverages and exclusions. There are claims paid everyday where if you read them to a reasonable person they would say the insurance company should not have to pay a dime, if that person was stupid enough to do that they deserved to suffer a loss however courts (and jury of peers) usually don't see it that way and see it in favor of the poor claimant. If he went to the store and bought boxes of fireworks and set one on fire with the intention of having the boat catch on fire that would be closed without payment, having fireworks on the boat that happen to go off while the boat is a blazing not a reason to not pay the claim. The fact that he did fireworks off the boat a week ago which resulted in no damage is also not a reason to close file without payment.

Again I know nothing about insurance, consult with your claims adjuster if you actually suffer a loss.

And These guys are dressed for winter....I wonder if they have PFDs on under those carharts?

Not carharts....... thermal barrier on the outside, vapor barrier under.. Very hot, it's actually a sticky wickett, as you should never wear structural fire gear on or near water since it does not float but being in close proximity to that amount of burning fiberglass will make things quite uncomfortable very quickly.. I'd be more concerned as a Company Officer about their lack of breathing apparatus..

After the 4th we had some left over fireworks. Of course the kids would love to fire em off from the boat but in the back of my mind I kept seeing a picture of our boat loking something like that.

Needless to say my wife and I thought better of it.

I can't imagine watching my boat burn. Those are amzing shots.

You are all missing the basic point - Where did the woman in the bikni go? That is what I would have saved, forget the boat. I bet she is now looking for another sugar daddy. Time to move in.

I do not even like to think about fireworks on a boat, especially from some folks who like to light candles

I had a six floor apartment fire in Germany some years ago, and that was more then enough for me.

LOL whered the girl go... Funny .. Anyone see Gary ? or better yet was she in the Bahamas on a 48......

LOL!
Moving in is a definate plan!

In my area, the fireworks usually start around 9pm, not 3pm. From the shots. . .it looks like this fire occurred in the mid afternoon, in weather conditions that would NOT be condusive for shooting off fireworks.

Of course, in another thread we are discussing the wisdom and hazards of running the blower while fueling. .... . . .I would not think shooting off fireworks would garner a positive response anywhere on this board

No such luck. He was on a new 55 the next weekend. It's a loaner that he may buy once they settle on the other one.

I was thinking the same thing and wondered of a 240 Sundeck of a different kind might get her attention for a week or 2. But somehow I doubt it.

Yep, it was 1-2 PM. About the time PC starts to fill up. Thus why he was coming in but wasn't tied up with anyone yet. He's one of a few anchor boats and was out early enough be the anchor for one of the 2-3 lines that usually start.

Pretty lucky I'd say.
