There are a lot of things I don't care for about D.C. but work brings me into town at least once a week. A few minutes ago I was driving on L street between 14th and 15th when a gust of wind blew through the shanty town known as occupy D.C. that gust picked up a tent and a blue tarp and sent it into traffic on L street just as I was driving by. The tent bounced over my car and was run over by a dump truck and the tarp landed on a car temporarily blinding the driver who almost crashed into the sidewalk.

That got me thinking. Who is liable if there had been damages? The drivers insurance? The federal government for letting them take over the park? I highly doubt anyone in the camp has any coverage on their tent home.

As I type this parked in my car I have a view of the hiddious gaggle of brown and blue tarps and piles of trash blowing in the wind. Meanwhile D.C workers provide trash service to those with the will to make the 10 steps to a trash bin. What a mess.

I would guess it would probably considered a road hazard as soon as it touches the road. This is how all these truck drivers get away with crap flying out of and off of their trucks all the time. Probably would be hard to figure out who was "occupying" that particular tent anyway. I was just reading where appreantly the Occupy DC folks have ruined 400K in landscaping in McPherson Square. I am still trying to understand what the idea is behind camping in all these parks rather than just doing scheduled protests. Of course I am not sure I understand their goals at all, not even sure they do.

The underlying goal of those supporting the movement financially is to maintain a presence to both support and prod the president in his re-election campaign while getting media coverage for their progressive causes. MM

Their goal is to confiscate as much of your hard earned money as possible!

Well that's not true, I wish I had a dollar from every windshield my company had to pay for, :smt021

PS, I was hauling screened sand and a guy said I cracked his windshield from stones falling off my truck. :wow:

At least around here if a rock or other debris comes up off the ground from a truck or comes off a truck then hits the ground before it hits you, it is generally considered a road hazard. The only way around this is if you can prove the truck was not loaded properly which is very difficult to do. If you call the trucking company (been there done that) they just tell you that it can't be proven or it is a road hazard and to call your insurance company, not them. You can get an attorney but who is going to go through all that trouble over a $50 deductible? Not me.

Sorry to hear about the Scammer trying to get you on the sand. They are everywhere!! :smt021

I realized today I was on I street not L when the tent blew over my car. I wrote the post while sitting on 15th at L so I was a little confused. Anyway the same 2 park police patrol cars were sitting idling doing nothing staring at the tent city. Meanwhile the park police is so understaffed they can't enforce traffic laws on the G.W. parkway or B.W. parkway. A fact that must make the protesters smile.

Jason, Heres another story.

I was driving on a back road with 22 tons of gravel 6" below the side boards on a dump truck.

When I turned onto the main road a lady started honking her horn and flashing her lights on/off at me.

She call 911 on me and said I broke her windshield. There were NO cars behind me at that time.
Guess who paid for her new windshield. :smt021

This is why NY State SUCKS !!! Her word against mine and they ALWAYS win. :smt021

But maybe they're telling the truth...that could be, couldn't it? Not everyone is a liar.

YES they are. :smt021. All trucks out here have to tarp their loads.

Come out here and try owning a CDL truck and you see all the liars come out of the woodwork !!!!. :smt021

Around here it is rarely material from the load that is falling off the trucks, rather the overflow material from loading that sits on fenders, bedsides, and tailgates waiting for the next bump in the road to fall and start rolling and bouncing down the highway. At interstate speeds I have seen 1-2 inch rocks fly 10 feet in the air after falling off a tailgate. The worst trucks are the type with a unloading conveyor belt, they lose material all the time and the tarp is of no use for that problem.

I have tried to teach all my friends and family to cognizant of what is around you while on the road. It amazes me to watch soccer mom with her pecious cargo sit right next to a truck, loaded with huge pipes held by a few straps, blissfully ignorant of the danger if one strap fails. If she understood the risks she would not sit there like that. I see people on the highway just sit by me towing the boat oblivious to the wind I'm fighting. I like to just get away from the trucks. MM

Yes it does happen once in a great while.

But tell me how a rock can jump out from under a tarp ???.

Trust me the scammers are out there. :smt021

Who cares were it comes from, that was my point in saying this.

Why blame it only on CDL trucks ?? Why not blame it on the cars that kicks up rocks from road. :smt017

Truckers are easy targets for this scam. :smt021

I'm just saying. :smt001

Wayne, I'm not talking about anything except what can come from the truck. The fact that it might be tarped does not mean that something can't fall from elsewhere on the truck.
