Everybody thinks what they have that was damaged is worth more than what the insurance company wants to pay. It was rare when someone said "thank you so much for all the money you gave us, it's more than we needed". There's a lot that goes into pricing and paying a claim then people realize. There's a lot of fraud as well. People would try to get me to pay for prior damage, pay for things that weren't even in the car, etc. So the insurance company should do their due diligence, and so should the claimant.
I've been involved on the insurance side as well as the insured side. It's similar to negotiating something you want to buy or sell from somebody if you're not happy with their offer. I've had positive, fair experiences with every insurance company I've had to deal with in my life. Maybe it's because I go into the claim not thinking they suck and I'm going to rape them for every penny they got.
And if insurance sucks so much, cancel all your policies.
Assuming you have full coverage on your car, if things aren't going well with the other insurance company, let your insurance company take care of it, let everything go through subrogation.
@Pirate Lady, this sounds similar to what my ex-wife went through, the kid alleged he had the green light and did not run a red light. So I can empathize. He got a ticket at the scene for running a red light. He hired a good attorney who got it thrown out in court. Everything eventually worked out the way it was supposed to. Insurance paid the claim.
Most of the ambulance chaser attorneys I had to work with when I worked in insurance claims didn't care about their client. They didn't care that their bills weren't getting paid. They just wanted their 1/3 of the settlement. I hope your situation is different.
