Shared dock

Quint, you've always struck me as a guy with a certain attention to detail. In fact, unless I have you confused with someone else, aren't you a first responder? Anyway, my point is, it's pretty obvious that dock is encroaching on the next lot. That should have at least raised an eyebrow, no? I know I'm looking at property and some of it is waterfront. So, for me, if I'm buying waterfront one of the key considerations is what's the dock situation and how big a boat can I put on it.

The GIS maps online today show so much useful info including elevation and lot lines, etc...

Not trying to be critical, but it seems like everyone should have known what was going on here. Docks that split lot lines can be beneficial for many reasons. I hope it works out for you.
 
As stated earlier....we used an attorney for closing and they did the title research. This is in NC.
 
Whom did the attorney represent? Not telling you what to do but you might want to talk with an attorney that will represent you and see what your options are. Did you have a buyers agent?

Yes I have always dotted my i's and crossed my t's.....but this got by me. The lot is deceptive in how the dock looks while actually on the property. It looks like it is very much on my lot when you walk the grounds and dock. Listing realtor and my realtor both still say it's squarely on my lot....but the GIS I found (maybe too late) seems to tell a different story.

We looked at over a dozen houses with docks and most are in the FEMA flood zone. This popped up with a dock and out of the flood zone. We flew down immediately and loved the house, grounds and dock. It was advertised as "boat dock" (not shared boat dock) and our realtor thought it was a private dock.

We made an offer and things progressed as I am accustomed to. I am/was in the middle of selling my current house and dealing with a medical issue and it got by me. So here I am.

I will say, I still love the house and property....it is awesome....so peaceful and I get to have a cold one on my deck and watch boats go by!

Be thankful you are not in NC, that would have been grounds for losing your license. Until a couple of years ago we did not even put sqft in our MLS listing in GA or NC because of the liability issues. I've seen agents get fined/reprimanded for using the MLS sqft. when they were the buyer's agent. It is just crazy sometimes.


Guess each state is different. I'm surprised they did not make you get a new survey. Do you use an attorney for closing? Who does the title research?
Ouch, Losing your license over something like as I described seems to be little harsh. Once we found out we were wrong we did what we needed to make it right. That’s what we carry E&O insurance for. For once I think MA is less strict on something.

I have no doubt this will get sorted. And, I want to be clear, I hope I didn't come across as negative...Not my intention...Just for the benefit of those who might stumble on this thread at some later date.

Anyway, I hope you get the medical issue sorted as well, and I couldn't think of a better way to spend time than watching boats go by...

I have been making lemonade from lemons for years....LOL.
 
I used to write contracts then I managed contracts. If you have not been involved with an item in the past you can some times miss a point. That is why all contracts have means to resolve extras. I learned long ago civil and fair is best way. In the end both parties want to feel they came out on top even though no one really did.
