Poking and bear with a stick?

Question, would you dare to do this? Three days ago we got notice from the IRS that they would not be refunding our $1300 from 2009 taxes due to it being over 5 years, ok I can understand and sorta deal with that. Yesterday we got another notice from the IRS telling me we owe them $1200 for filing our corporate taxes late...we didnt owe them money, just filed late, again from 2009. My question is this, would you send them a copy of the first letter along with a copy of the second saying I think we are even? Or would that just be poking a big bear with a small stick?
 
I dont have a problem poking that bear with a stick , i would pickup the phone and call them , i would also talk with my tax man to see where i stand .
 
I've talked to our tax folks....she says to try it, I just wanna hear some other opinions
 
Years ago when I first started my business I had a part time receptionist. Through a couple of stupid assumptions on my part I did not deposit her withholdings. At the end off the third month I figured it out and filed the three monthly filings. The filing contained a field for unpaid deposits and one for unpaid deposits carried forward. On the first month I calculated the tax, marked it as unpaid and on the second month placed that amount in the unpaid carried forward box, and so on to the third month when I submitted the full amount of tax on time. I thought I was square with the IRS. Then the letters started telling me I was in deep poo poo for the unpaid tax on month one and two (nothing about what therefore was overpayment on month three). I would write back and explain and in a while another letter would arrive ignoring what I had written. This went on for about six months and finally I called my accountant. I had wanted to avoid this as it was less than $100. His solution; pay the taxes and be done with it - Logic does not live at the IRS.

My thoughts, do what they want, unless you enjoy pointless aggravation.

Refunds are stopped after 3 years. Balance due never goes away.

Just a question....how is that fair to me? They keep my money then demand more?

I did sent copies of both letters to a representative from MD, that is part of the committee looking into the IRS and it's recent actions
 
I wouldn't call them. I'd prefer to visit their office and sit down with a real person, face to face, and explain what you posted above. I think you'd have a much better chance.
 
I didn't sleep at Holiday Inn last night, but 2009 is not 5 years ago.

apologize to the IRS and call it even.
 
After seeing the news this morning of them line dancing at a cost of $1600 to the taxpayer.....I really think we are even! Maybe I can tweet the president and ask him if this is a bad idea
 
Just tell them that you joined the Tea Party last year, and have had nothing but problems with the IRS ever since...

This I think is good advice. An IRS audit agent and their managers probably have the empowerment to make a call on your behalf. Service agents on the phone I believe probably can't do much.
 
Why you messin' around with 5yo returns for anyway? If you don't want to pay late filing fees then don't file late. This is about the 4th whine you've made about tax problems, maybe you need some new 'people' handling things for you instead of telling you to go ahead and give it a try. For 1,200 bucks I don't think it's worth showing attitude to the IRS. Pay up...I don't want anything holding up my SS checks and other free stuff.:smt043
 
We found issues with our files from 04 to 09, some good some not so good...some years we paid when nothing was due others we were owed. This filing we found that our Coreprate paperwork was never done, so we corrected it....then we got hit with this fee. We can't get any of our money back, but we sure can be hit we these fees and fines....whining yes! but this stuff is getting old fast
 
Take your medicine says I. Addressing your 2009 taxes in 2013 will certainly not endear you to these guys. If refunds are stopped after 3 years, is it for refunds on taxes never filed only? It seems as though it's time to look in the mirror and see why you are out basically $3,100. The IRS did nothing wrong for a change, they are just making a point with you to follow the rules and file on time.

Thank you...that right there is my worry....I own a business and they can big a pure pain if they wish. I am going to try to talk to someone about it, but the check will be in my back pocket
 
No, the new accountant has been very helpful when it comes to all this and she's been kinda the middle man for us. It's just this one rime, with the IRS, all other years everything has been done right. We already know the cash we paid is lost and the cash owed to us is also lost... I will pay the fine if needed...it just hurts to know they owed me more than the fine is and then to see all the stuff on the news....yea yea..pay um and move on

Your situation does suck, but I know when you have a biz, they can get VERY tricky if they want. I would arrange a meet and have my check filled out ready....just in case you can't call it quits. Do hope it works out. FWIW we got a bill recently for another $4k+ in taxes from 2010 for someone else's tax on a 1099 which of course we didn't list! One of our S/S #'s was typed in by mistake on electronic filing! Managed to get it sorted out but it took months amid threats of tax court, high court, basket ball court you name it....Good luck!
