I need an attorney referral for litigation against a broker

I am considering litigation against a broker for selling me a boat advertised with “brand new†engines. I have come to find out from Mercury that they were not “brand new†– not by a long shot. I prefer a firm in Florida, preferably in Tampa Bay.
 
I would not know who to refer you to. Sounds more like you have an argument with your surveyor as that is who's job it is to confirm the specs on the boat, assuming you hired one. Otherwise its up to you.

Well.........I think it is a legitimate question, however, unless he is looking for a lawyer to sue under admiralty law a boating forum is probably not going to get him an answer he needs. He probably needs to see a general civil attorney in the location where he wishes to bring suit.

Unless there is someone like Jim that is familiar with the law reguarding brokerage arrangements or agency, about all he will get here is some second guessing.

A seller's representations and disclosures are supposed to be truthful. He might have a case. Time to do your due diligence. (Finally do some due diligence?) Call a number of attorneys in your area and interview them. If you have a family attorney, ask for references.

When we were boat shopping I read a lot of literature and boat ads. Over time I became familiar with one model, the boat I was researching. Many boat ads had errors, all sorts of errors. Even simple things like the boats beam was often incorrect in the ad.

The idea here is to hire a surveyor to check out the boat and give you a written appraisal on the boat and its condition.

If your ‘new engines’ were in an advertisement I don’t think you will win. Most of the ads I see have a disclaimer at the bottom. Even without this it’s likely implied. If it’s in a contract then you have a case.

Did you get a survey?

Does anyone know a good "slip and fall" lawyer in the NJ area. Threre's going to be a class action suit by all the people whose feelings Gary has hurt. :smt089

I'd also like to say that I agree with Juan Chan Wong's thoughts above.
