Cobalt Files Lawsuit against Sea Ray

I may not remember correctly but dosent Ron work at cobalt now,former searay ceo?
 
JMHO Cobalt will lose this one. Storage location and method of deployment are totally different. End result the same. I think i'll make one myself to install on my 390. Thanks for the idea. When I get it done don't ask for pics. I can't afford a lawsuit. :grin:

After looking at the patent and the photo that wishtofish posted I don't see how Searay is going to win this one. Its almost an exact copy of what was in the patent.
 
One way for Sea Ray to defend themselves would be to show that there was prior art, ie show a boat with a similar setup before the patent was submitted. I was a designer on one of the first digital answering machines and a competitor had patented "one touch playback" meaning you could play back the message by touching one button. We had to change ours before it was released to have two button presses to play the message. Patents can seem silly at times but that's the rules you have to play by.

Prior art is a bit.. iffy after the changes to the US patent law. Now it is "First to File" which determines who owns the patent. Before Prior art had a bigger impact but now it seems less so since 2012? "reform".

Before you had to keep notebooks upon notebooks of meeting details detailing the invention with each day signed and logged to prove the first day of invention. Now it is how gets the lawyers in there first and put a fingerprint on the "invention"
 
Yes but you also can't patent something that is already in the public domain. So if Sea Ray could show a boat, and it wouldn't even have to be theirs , that had a swim step like this that was sold prior to the patent being filed then the patent would have to be nullified. I have not seen a boat like that before so in my opinion Sea Ray doesn't have much of a defense in this case.
 
Funny, I saw this on a Colbalt in Miami last year or year before and said "everybody will copy this"..... If I can find the hinges, I may cut two into MY platform on either side of the swim ladder..How cool would that be!!

As far as the patent, it's all about the wording and damn lawyers.
