Michigan Woman Faces Civil Rights Complaint for Seeking a Christian Roommate

A civil rights complaint has been filed against a woman in Grand Rapids, Mich., who posted an advertisement at her church last July seeking a Christian roommate.

The ad "expresses an illegal preference for a Christian roommate, thus excluding people of other faiths,” according to the complaint filed by the Fair Housing Center of West Michigan.
"It's a violation to make, print or publish a discriminatory statement," Executive Director Nancy Haynes told Fox News. "There are no exemptions to that."

Haynes said the unnamed 31-year-old woman’s case was turned over to the Michigan Department of Civil Rights. Depending on the outcome of the case, she said, the woman could face several hundreds of dollars in fines and “fair housing training so it doesn’t happen again.”

Harold Core, director of public affairs with the Michigan Department of Civil Rights, told the Grand Rapids Press that the Fair Housing Act prevents people from publishing an advertisement stating their preference of religion, race or handicap with respect to the sale or rental of a dwelling.
"It's really difficult to say at this point what could potentially happen," he told the newspaper, noting that there are exemptions in the law for gender when there is a shared living space.

But Joel Oster, an attorney with the Alliance Defense Fund, which is representing the woman free of charge, describes the case as "outrageous."

"Clearly this woman has a right to pick and choose who she wants to live with," he said.

"Christians shouldn't live in fear of being punished by the government for being Christians. It is completely absurd to try to penalize a single Christian woman for privately seeking a Christian roommate at church -- an obviously legal and constitutionally protected activity."

Haynes said the person who filed the initial complaint saw the ad on the church bulletin board and contacted the local fair housing organization.

The ad included the words, "Christian roommate wanted," along with the woman's contact information. Had the ad not included the word "Christian," Haynes said, it would not have been illegal.

"If you read it and you were not Christian, would you not feel welcome to rent there?" Haynes asked.

Oster said he hopes the case will eventually be dropped and that he's sent a letter to the state asking the authorities to dismiss the case as groundless.

"The First Amendment guarantees us Freedom of Religion," he said. "And we have the right to live with someone of the same faith. The Michigan Department of Civil Rights is denying her rights by pursuing this complaint."

But Haynes said officials plan on pursuing the matter.
"We want to make sure it doesn't happen again," she said.

Seeking for a "woman" rather than a "generic gender" roommate would be as discriminatory, wouldn’t it???

Do not weep for your country, LTD! All the world is going through the drain nowadays...

Let me cheer you up a little showing what is happening in my country, just an example.

This is the most beautiful place on hearth were a tourist can find history, beauty, art, nature and culture as nowhere else! Italy should be some kind of Paradise on Earth where everybody spends his vacations having a careless good time. But it’s not. :smt009

I have no doubts in stating that we are experiencing a new form of dictatorship. (again!!)
Our prime minister owns or controls all the media and there’s not such a thing as a completely free journalism… but there some counterpart in that…we can now offer a new kind of touristic attraction to our friend abroad: come to Naples and we will offer you beautiful views over the magnificent gulf and the overflowing local garbage!!! :smt013

Now, I am:smt089 :smt089 :smt089

Sorry for spoiling your thread, Gary

FYI: a few months ago we had to pay Germany to dispose of our garbage in Naples….

Unfortunately she is probably going to lose the suit.

Religion. Advertisements should not contain an explicit preference, limitation or discrimination on account of religion (i.e., no Jews, Christian home). Advertisements which use the legal name of an entity

which contains a religious reference (for example,

Roselawn Catholic Home), or those which contain a religious symbol, (such as a cross), standing alone, may indicate a religious preference. However, if such an

advertisement includes a disclaimer (such as the statement "This Home does not discriminate on the basis of race, color, religion, national origin, sex, handicap or familial status") it will not violate the Act.
Advertisements containing descriptions of properties

(apartment complex with chapel), or services (kosher meals available) do not on their face state a preference for persons likely to make use of those facilities, and

are not violations of the Act. The use of secularized terms or symbols

She probably could have got away with the female roommate do to the shared living area exemption.

Fair house laws can make real estate ads interesting.

Clearly what you cited would apply to someone renting to a perspective tenant but isn't this woman simply seeking someone to rent with? Just my extra 1 cents worth non-legal perspective.

So my advertisement for a tenant (roommate) as follows is inappropriate?

Wanted dark hair green eyed vixen to share time (some days longer than others) with a great guy with a nice boat. She must be super hot with lots of hot girl friends who are always welcome, loves to cook gormet meals, is a neat freak and cleans the house to a sparkle.

Religion is not an issue just as long as you are smoking hot and is willing to put up with me. No uglies or males are to reply.

Nope, roommate advertising is still covered under fair housing the only exemption is the male/female in a shared living area. Those do not even apply if it is not a shared living area like an detached garage apartment.

Wanted: Gun owner needs roommate that won't get on his nerves... Christians tend to calm him down.

It should be an interesting fight. She can claim that the fair housing thingy infringes on her right to free association as rooming with a non-christian would diminish her "message" of christian living referencing Hurley v. Irish-American Gay Group. This is a logical argument since christians are to "teach by example." By living christian lives, they are therefore engaging in speech, which is protected. Living with someone who is a non christian might inhibit her example, prayer, etc. She has a shot. Of course, I'm not an attorney, so who knows?! But I think it'll still be interesting.

On the other hand, this is why some states with activist and intrusive laws and regulations are on the decline. Who would want to deal with crap like this? The force their silly regulations on individuals and businesses. Those with the resource simply pull up and leave.

Yes, and so I would not call her! So she saved me time. Thank you for making the ad specific so I know not to bother calling about it. Sheesh.

Too many rules. And too many stupid rules too - but mainly - just too many rules.

Pietro,
Let start off by warning you that your Prime Minister is probably reading your posts and is sending his goons to your house/boat as we speak!! Here in NY we had a problem with some garbage a couple of decades ago and put it on a barge and sent it all over the country and no one would take it.

So I can understand your embaressment. That being said, my In-laws travel to your country every year and rave about it's beauty and rich history. So you can stop weeping my friend, all reports are still good by me!! I can't say I'm in a hurry to see all that garbage in Germany though!
