Be interesting to see how this pans out. Mass. has some of the toughest laws in the country when it comes to BUI.

"Alcohol and Drugs

Massachusetts has one of the strongest Boating Under the Influence (BUI) laws
in the nation. Massachusetts law prohibits anyone from operating any vessel
while under the influence of alcohol or any controlled substance.


  • Massachusetts law states that a person is considered to be boating under the
    influence (BUI) if he or she has a blood or breath alcohol concentration of
    0.08% or greater.
  • Massachusetts law establishes the following penalties for BUI:
    • Those convicted for the first time of BUI may be imprisoned for up to 30
      months, and fined up to $1,000 or imprisoned and fined. Offenders may also have
      his or her motor vehicle license and vessel's registration revoked for up to one
      year.
    • Repeat offenders will receive more severe penalties.
    • Offenders convicted of BUI and causing serious bodily injury to another
      person may be imprisoned for up to 10 years and fined up to $5,000.

  • By operating a vessel on Massachusetts' waters, you have given “implied”
    consent to alcohol testing if arrested for boating under the influence. Anyone
    who refuses to submit to a blood alcohol level test is subject to having their
    motor vehicle license and vessel's registration revoked for 180 days.
  • It is illegal for the owner or operator of a vessel to knowingly permit it
    to be operated by someone under the influence of alcohol or any controlled
    substance. "

I think BUI should become a capital offense with immediate DBD imposed

So sorry to read about such an awful accident she will never be the same again, so sad and unnecessary. I hope someone locks him up and throws away the key, but I doubt it.

13 people on the boat. Is that a lot for that size boat? I would go crazy if I had that many people in the cockpit.
We would, too. First Mate and I max the passenger count between 4 and 6 so everyone can be seated comfortably topside and we can move about easily to deal with ropes and such for docking; most often we limit to 4, though, just for personal preference! If we used the cabin, we could carry about 12 and not be sardines, but everybody would have to go sit on another boat or vacate to floats for us to truly enjoy the day!

Safety-wise, I was a bit surprised to learn from SeaRay that vessels (yachts!) of a certain length aren't rated/labeled for passenger capacity in the same way smaller craft are--I had asked to make sure I had the minimum required number of life jackets on board.
 
I wonder if he had enough life preservers. With him being 33, it makes you stop to wonder about the girls under 20 on his boat. Not that that's illegal of course.

So here we have a bar owner who, either by accident or by design, was serving booze to people under 21 and got caught doing it. I wonder how many of the people on his boat were under 21 and had been drinking. I wonder if the USCG gave all of those people a BAC test.

9 women between the ages of 19 - 22. I had the same question but haven't read anything yet that indicates what action was taken with passengers, whether men or women. The article I linked said none of the passengers responded to the writer's inquiries.

Really???? So if someone is over the legal limits even slightly and they are pulled over they should be drowned?
