Boating hit and run, what to do?

Very minor scratches around the eyehook on the front of my boat and some black marks that will come off with some elbow grease, however I feel the need to report this one.

Yesterday I was anchored front and back in Party Cove. A bit of wind but i was not moving pretty much at all. I'm in the water sitting on my life raft behind my boat and another boat comes across the front WAY too close to my anchor line, the driver isn't paying attention and his buddy in the back says, "you're getting too close, turn the wheel! NO TURN IT THE OTHER WAY!" and then he turns the other way and gives the boat gas. Basically he would have been fine if one of them had put their foot out to push off of my boat or probably if he just went straight, but because he turned away from my boat and gave it gas, the deck on the back end of his boat whipped around and made contact on the eye hook area. I was not there to see exactly what hit and where, but this is all I can tell from the marks on my boat and what could have possibly made contact from his boat. I am pretty sure it was the swim deck of his, the bolt on kind, not molded into boat like mine.

I immediately got out of the water and went to the front of the boat to see what had happened, mean while this guy DRIVES OFF. I said "hey, stop! you just hit my boat!" ... my buddy said he remembers the driver saying "oh, sorry!" as they drive off slowly. I yelled again "STOP! YOU JUST HIT MY BOAT! DO NOT RUN OFF!". Continued to drive off and they anchored about 200-300 yards away. I tried to get the TX numbers off as they were driving away, but couldn't due to the angle. So I immediately pulled up anchors and we cruised over there. I got close and the guy driving still didn't give a crap at all, his buddy was trying to calmly say they were sorry, and one of their wives decided that I was accusing them of something (duh!) and try and pick a fight with the girls on my boat (wtf? it's your fault).

I backed off a bit, threw anchor and got into the water to look at the damage and it is pretty minor but could have been much worse. I swam over to their boat and the nicer buddy of the driver met me half way and we discussed that it was a bit scratched but could have been much worse but that you CANNOT drive off, it's a hit and run just like a car. I asked who's boat it was and of course he said it was a rental......

After a 15 minute fight to get my anchor loose I flagged down one of the game warden's as we were leaving and asked them what the proper thing to do is, he said to get the TX numbers (as I already had) and call Texas parks and wildlife to report the accident and they will find the rental company that owns it. They have insurance for claims against their boat when renters are using it.

Like I said, it's pretty minor scratches in an area of the boat that gets scratched and worn a bit due to getting boat on/off trailer, however I feel compelled to turn this in due to the hit & run aspect and not caring at all that he hit a boat. Obviously the rental company didn't teach him a single thing if his buddy is yelling at him to turn the other way too! It simply amazes me that anyone with a few hundred bucks can get in a boat with no prior experience or training and drive off. We see rentals blowing through no wake zones and things all the time unfortunately on Lake Lewisville... ugh. Rental places need to be responsible and show their renters how to drive!

Any advice on this? :huh:

I would report it. And see what happens. Even if you can fix the damage yourself the supplies still cost money. And your time certainly costs money. I would also get it checked out by a pro to see if there might be any very small cracks or anything.

I don't see anything positive coming out of you filing this report. Next thing that could happen is the rental company comes after you and your insurance (not saying that would happen, but it could...).

I would just write this one down as just another example of idiots on the water and let it go. You were lucky that the damage was not worse. Just my 2 cents.....(hey...it's free advice...and worth just that!).

yeah, getting it checked out is probably not a bad thing. I am by no means a fiberglass expert.
 
Sorry for your situation. This is exactly why my family and I do not go to Lake Lewisville unless it is on a weekday. I would follow through with the insurance to the rental company. The way I see it is if they have to pay more for insurance, they will have to charge more and maybe it will reduce the number of idiots that get a hold of the keys.

I don't see anything positive coming out of you filing this report. Next thing that could happen is the rental company comes after you and your insurance (not saying that would happen, but it could...).

I would just write this one down as just another example of idiots on the water and let it go. You were lucky that the damage was not worse. Just my 2 cents.....(hey...it's free advice...and worth just that!).

True, it could open a can of worms. I wonder if first I should find out who owns the rental boat and then call them that someone renting it hit and caused minor scratches, just to see what they say.

I agree with this idea. Call the rental yard and tell them what happened. They are responsible for their equipment and if they are renting to idiots they should at least know. I think maybe a baseball bat to the driver's knee was in order...:smt021

Lobby for mandatory licensing. Having a license won't prevent idiots from being idiots, but it will require them to at least be trained monkeys and keep the untrained monkeys from being able to legally rent.

Not a can of worms that you want to open. Mr. Crash and his friends will say that you ran into them. For minor damage, it is not worth your getting angry about. Also forget about calling the rental company, they will just upset you because they are not about to admit to anything that may cost them to lose their insurance or raise their rates. They are not interested in you or their crappy boats. They just want their junk in the water earning income and they don't care who the idiot is that rents it. Just my humble opinion.

I don't mean to be a jerk about this, but after the game warden gave you your options it became a question of whether or not to follow his advice, or just say Screw It and fix the scratches yourself.

If your reason for this post was to let us know that jerks rent boats, thanks but we were already aware of that.

If your reason was to garner sympathy, job well done.

I agree. However, I think he is trying to CS someone into paying for minor damage and using the thread as a sounding board. - Not a good idea.

What's a hat gonna do? Wouldn't a BAT be a more effective deterrent of future bad behavior? :grin:
 
I'm of the belief that people need to be responsible and endure the consequences for their actions - especially adults. If it were me, minor or not, I would report it - whether you fixed it yourself or not. You said you didn't see it. Maybe something else is damaged, something you cannot see, maybe not. They hit YOU. Protect yourself - no one else is going to. At the very least you have a recorded record of the incident.

I poated this on another thread but thought it might help shed some light on your options.

Saturday afternoon I was sitting in my living room when I heard a large truck pull up my drive. I looked out the window to find the local fire department trying to back up and turn around in the drive. No big deal cause I really respect these guy's.

The first attempt the driver made would have put him 2 ft off the drive completely. Knowing this they sent a spotter out to back him up. The spotter backed him into the drive with one wheel on the driveway and the other on the lawn. The spotter jumps back in the cab and they take off leaving a hugh rut in my lawn.

I am now faced with a dilemma. Do I rat on these guys or just leave it and fix it myself. After a few minutes I call the station and explain to the person on the other end what happened and that I was going to take care of the damage, I just wanted them aware of what happend. They sent to fire marshal out to inspect the damage and he made a report. I don't want these guy's fired but I do want them to know there are consequences for their actions.

This person needs to pay for his mistake. It aint a cheap lesson but it will last him a long time.

I agree, it could get ugly with the insurance and there's a remote possibility that the other boat would say it was your fault somehow and your insurance may go up

This is a zero event, the guy did not run away and the guy that says he got hit can't even prove any damage.

ADVICE: Forget it, this is a lot of chit chat about nothing.
