Bay Constable

The Bay Constable is there to "Protect the Resources" if your not doing any Illegal Fishing or Keeping Shorts there should not be a Problem!

Folks were ignoring the 5mph no wake zone where the Amity Cut meets the state channel in front of the Heading. They have just recently restored the 5 mph signs that were stripped away by Sandy.

Typically the water cops in any locale are charged with enforcing all laws. If they stop you for a safety check they do have the right to board you for their safety and yours. Once they are on your boat they do not have to ignore anything they observe that might lead them to believe there is a violation of one of the myriad laws they enforce.

If you were in an area that had a speed limit and you were exceeding it by any amount he can stop you for that violation. Normally they won't stop a boat that isn't exceeding the speed limit by an "unreasonable" amount.

That being said, I noticed that you posted a gripe about him but didn't say why he contacted you or what he did to ruin your day. Arrested? Cited? Warned? Was he rude? Tell us a bit more so we can decide if your day was unreasonably ruined.

Safety first I say, he's just doing his job. Comply with the regs and you have nothing to fear!

Really??? Should we send the cops over to your house and have them check to make sure you are not doing ANYTHING wrong? I am sure you are good since you: "Comply with the regs and you have nothing to fear!" I am glad several states are passing laws that require probable cause to stop boaters. (This unfortunately does not apply to the Coast Guard) Since 9/11 even tiny jurisdictions were given money from the Feds to buy boats. In many little harbors there will be the CG, the Sherriff, and the local police tripping over each other with the little guys trying to prove their worth...

I always wave.....seems to help. They also know I have a concealed carry permit and a gun on board. Equal respect, Mike.

Leave me the F$%# alone unless I am:

A - Doing something that could hurt somebody.
B - Acting suspicious in the vicinity of a military vessel or identified target threat.

I'm guessing law enforcement equates stopping boats for safety checks the same as driver's license roadblocks/DWI checkpoints when in your car?

I met him 2 weeks ago. He asked me if i knew that i was cruising in a no wake zone. He pointed to the place where there used to be a sign that Sandy took away. Checked my Reg, flares and said to follow the speed limits in the marked channel.

Then get the sign back up! Duh!

If you are a south shore boater for any amount of time over a year, then you are familiar with the 5mph zone down there. Clearly marked for the last 50 years. Besides, that stretch is right in front of two active marinas.

I'll bet you wished that you could have had the argument (for argument's sake - with impunity) that if the sign is gone, it is considered an "unmarked channel". He really should focus on getting the sign back up before giving folks a hard time. Everyone that goes through there for the first time does it at least once.

I like popcorn. I was at my local West Marine last week and had a discussion about the CG inspection stops in our area. The conversation normally lead to what safety equipment that is needed and how to use and store it on the boat. I knew that PFDs need to be out of the store packaging but the store manager pointed out the label on the PFDs six pack tote bag. On top of the tote bag the label states that the bag must be unzipped and open while the boat is underway. Gezzz, I never had a problem to unzip in an emergency. Did I mentioned I like popcorn.

I like popcorn too.
I have boated in the area for many years. The main point is Without any signs how is a boater to know about the no wake zone or whether or not there is a sign missing. Put up a new one... For the record, i was slowing down to an idle probably doing 7 or 8 Mph.
