Two schools of thought.

1) It is my understanding that the fire starters in Oregon have been busted for poaching in the past. I read that the fires were set to cover up their tracks. This was a statement from a relative in the court proceedings. They were presumed guilty and served their sentence.

2) Going back and adding 4 more years to their sentence after it was served? Wouldn't that be 'double jeopardy'?

Like the Bundys, I was 'for the cause before I was against it'. The reasoning was, I didn't get the full story about their use of Federal Land. However, I do believe that BLM, EPA, DNR and Feds have 'WAY' overreached with land grabs and squeezing people on adjacent lands - or god forbid, have a water source like a pond on private property.......

I also find it interesting that the Feds have sent more assists to this and the Bundy ranch than they did Benghazi, but I digress.....

No. They weren't re-tried. The original judge failed to follow the mandatory minimum sentencing guidelines. There's a reason they are called "Mandatory" - he overstepped his discretion. The appellate court fixed his error.

Now, the justness of mandatory minimum sentencing is a different issue, and there are pros and cons to it, but they are serving the time they were supposed to serve.
