SPX 210 Hull deficiency, left tilt at medium speed

We bought a new 2018 SPX 210 in May this year. After the third ride we noticed that the boat was tilting left sided at medium or higher speeds. We alerted the dealer right away and a Sea Ray customer service person got in contact with us. We were told that they would try to diagnose the problem. It took several weeks until they came up with a diagnosis, that the hull was uneven, causing this driving imbalance. Sea Ray proposed, to send a team out to put some fiberglass/new gel coating on the right side of the boat, technically speaking putting a hook on to fix the problem. However it became clear that the hull has a manufacturer deficiency and that Sea Ray just want to patch it up instead of replacing the boat, because of a structural deficiency. Up to this day Sea Ray declines our request to replace the boat, despite the fact, that it is a deficient boat manufactured by them. They are telling us, that nobody would notice the defect after they slam some gelcoat on the hull. We consider this bad warranty behavior. Sea Ray says: they stand behind their product and help you in any way to enjoy their high quality product. Unfortunately our boat is the opposite. Sea Ray said, that this doesn't happen very often and as a single customer affected, they don't care about our satisfaction and therefore they are trying to get away cheaply. In this entire process it has been very difficult to communicate with the Sea Ray company customer service. We never have received exact information, what really is wrong with the boat and multiple efforts to speak to our customer service person were unsuccessful, as phone calls were never returned. Overall extremely unsatisfying experience. We bought a new boat, but now they want us to accept a repaired boat, just after 3 months of ownership.

Has anybody had similar experience with the Sea Ray customer service dept or warranty? Thank you
 
Did you not sea trial this boat before taking delivery? Was the list not noted during sea trial?
 
It is easy to find the contact information for the executives at SR. Reach out to them directly and ask for help. I have found them to be very responsive. Now, there is the chance that they stand behind the decision you have already been told. In that case, consult legal counsel and see what your options are.

Our 2008 210 Fission lists to the starboard side and I thought that the reason was that both batteries are on that side. I never thought that the hull would be deficient. It sits that way at rest in the water as well. Not sure if I can do anything at this stage of the game except move both batteries to the port side and hope that fixes the problem.

I find this very hard to believe.
 
I agree and would find it hard to believe SR would say something like that. My experience has always been positive.
