Anyone transferred a boat to Illinois from another state? Did they ask you to pay Sales Tax on a boat owned for a period for 4.5 years where you paid documentation tax and annual personal property tax in the state you bought the boat and originally used the boat? Specifically tax for the original sales price?

Skolbe I don't think you would be subject to IL sales tax since you are not changing your residence. There is no personal property tax in IL. I think you only have to pay the registration fee.

The guy at some registration office thought I owed sales tax for the whole purchase price - and they give no credit for documentation or in-lieu tax in MO. I have owned the boat for 5 years and traded my old boat. I moved marinas to Illinois and I understood that I was required to reregister the boat. Thanks for the post.

I would call the IL Sec of State's office in Springfield to get the correct info.

There is really no FAQs section on the IL DNR site. Here is an exerpt from registration of a watercraft:

CLASS 2 - 16 ft to less than 26 ft
CLASS 3 - 26 ft to less than 40 ft
CLASS 4 - 40 FT and over

If you have any questions call (217) 557-0180 or 1 800 382-1696.
Department of Natural Resources information is available to the hearing
impaired by calling DNR’S TTY: (217) 782-9175

Tax Notice - Watercraft purchased new or used from manufacturer’s,
lending institutions, or dealers are subject to tax. Effective September
1, 2004 tax is owed when a watercraft (class 2, 3, 4 and personal
watercraft (PWC), i.e. jet-skis) is acquired by gift, donation, transfer, or nonretail
purchase if the watercraft will be used in Illinois. You must contact
the Illinois Department of Revenue at 1 800 732-8866 or 217 782-3336
for instructions before submitting an application.

I would be very surprised if you do not have to pay what Illinois calls a use tax. I sold a boat last year and took a trade. I had to pay 6.25% of the value I used in the sale. I even had to produce a copy of the paperwork we used on the sale to prove my stated value. We in Illinois must be sure to soak "THE RICH".

I would never register a boat here if I didn't have to.

What if I am moving into Illinois with a vehicle I own that needs to be titled?
If you originally purchased your vehicle from a dealer, lending institution, leasing company, or other retailer, you must use Form RUT-25 when you bring the vehicle into Illinois. You should attach a copy of the bill of sale or other proof of the purchase price. If you had the vehicle titled in another state for more than three months, you must use Form RUT-25 to reflect the fact that no tax is due.
If you originally purchased (or acquired by gift or transfer) your vehicle from an individual or other private party, you must use Form RUT-50 when you bring the vehicle into Illinois. If you had the vehicle titled in another state for more than three months, you must use Form RUT-50 to reflect the fact that no tax is due. Note: The purchase (or acquisition by gift or transfer) of a trailer or mobile home from an individual or other private party who is not a retailer of vehicles is not subject to this tax and does not require a tax form when you apply for title.
On both Form RUT-25 and Form RUT-50, the exemption for using the vehicle outside Illinois for more than three months applies only to individuals moving into Illinois. It does not apply to businesses, leasing companies, or lessees moving into Illinois, or military persons whose home of record is in Illinois. In these situations, tax is due; however, a credit for tax properly paid to another state and a reasonable allowance for depreciation for prior out-of-state use are allowed.

Note: For more detailed information, refer to the instructions provided with each form.
