But Frank, Boatman is looking for a boat at $30k and under, so at a standard commission of 10% we are talking about a commission liability of under $3000. Is that worth suing for? It's barely out of small claims court. And are they willing to risk the negative vibe in a deal like this.

Boatman, one other thing....Your seller could go to PoopYachts and appeal to them to accept a smaller commission. As the song says, "A little bit is better than nada."
 
Yeah. Whatever they do is between them but just hope it doesn't drag things out. I'll go find another boat if that happens

That's the smartest comment I have heard on this thread - Pop Yachts, their contract, the commission - it's not your problem, and don't make it your problem. Make an offer to the seller, they either take it or leave it. Even if you know them, don't get involved in the back side brokerage mess with them.
 
Just talked to the seller and they said they were able to cancel the deal with PY and are free to sell on their own. Next step is I want to get a closer look

When we were looking, about 2 months ago..mebbe 6 weeks ago, I had seen a Formula 31. I had seen it through another site or maybe locally, and based on the pictures I thought I recognized where it was (in the storage yard across from a popular bar called The Back Porch, in Old Saybrook.

One weekend I was cruising all sorts of classifieds, to see a few listings at PopYachts I created an account there, scrolling through I saw the Formula again and this time wanted to see it. I reached out to the listing agent asking to confirm it's location so I could do a "drive-by", she said "Yes".
About an hour later I received an email from another PopYachts broker with a stern lecture about DO NOT view on your own, do NOT contact the seller.

Yeah, too late, I already went to that yard, saw a sign on the back of the boat that the owner had on it, and saw the owners listing price (16k)(plus his phone number)....POP Yachts ask was 17.5k. Owner showed it to us, said he had lots of wiggle room he needed to unload it fast to move out west with his family...they retired.

Luckily I used my junk GMail account to sign up...it fills with so much spam now from PopYachts about other boats. Gave me the impression that they're the definition of a slimy used car salesman.
 
On another popular boating forum I recall a post about PopYachts...how someone who was selling their boat privately had managed to find their boat listed at PopYachts. Apparently they'll try to poach sales by scouring classifieds and re-listing boats without sellers knowledge.

Yeah, they said PY listed it way higher than they wanted to list it knowing it would never sell. They said they had signed with PY in April or May and it had already been dropped by $7000 in that short time.
 
I am a broker in Wrightsville Beach NC. I try to stay low when Popyachts threads pop up. These guys are high among the things that give brokers a bad name. Folks, do your homework, ask for referrals etc, there are good brokers out there that will have YOUR best interest at heart. Ya just gotta look.
 
The interweb is your friend. I did a little research. Doesn't seem like Pop Yachts is a "broker" at all. Really just a listing service. Add use of high pressure and some less than desirable tactics.
 
The seller of the one we are looking at said she listed it with PY and the agreement was that they would come and take pictures. She said they called and told her they didn't have a broker within 250 miles so told her she would have to take the pictures and send them to PY's. So they have never seen the boat.
 
The trick with pop-yachts from a buyer's perspective is to NOT create an account. They track any boat you look at and and use that to justify their commission if you try to bypass them.

I found out about the tracking when I kept stumbling across a "34 foot", 30 foot boat. (they use LOA in bold letters and length on deck in the fine print). After getting sucked into this one ad a few times, I started getting emails from some guy asking what I didn't like about the boat.

Not sure if I created an account with them. I think I must have a year or so ago because I get emails from a PY agent sending me different boats every couple of months. And also get the occasional 'I see you were checking out a boat'. Still can't say that I ever clicked on the particular boat we are looking at.

Interesting admission. But not your problem, If you like the boat , make n offer, up to her to decide.
 
They contacted me when I was selling my old boat. The deal was that I tell them what they want for the boat, send them some pictures and information, and they tack their commission on top of that then list it in their site. They never look at the boat at all. Seemed strange to me.
Luckily I never got that far in to it with them. The boat sold in less than 24 hours to the first guy that looked at it.

Read carefully.......I said: "Threats and fear of a lawsuit......." probably accompainted by various threatening letters on an official and expensive looking letter head from Dewey, Cheatum and Howe, Esq. But I agree that a $3K comiisiion isn't worth going to court over.
 
They have contacted me repeatedly about my Craiglist ad for my current boat. Same deal. Said that I can still try to sell it and they only get a commission if they sell it. Said that there was a huge demand for my 1963 WallaceCraft. I said really I'm having a hard time believing that since there are only about four left in the world. The guy did not know what to say then and just hung up.
 
UPDATE: Well not sure what is going on with this boat now. Been going back and forth with the seller and seems like not much is happening. Getting close to the point of walking. Been talking to her all week about having the shop de-winterize it for survey and sea trial tomorrow. She emailed me yesterday to say that she doesn't think they got that done yet but said she will call today to find out. She left yesterday to go camping and said she would come back tomorrow if she has to. I told her my bank would need her payoff so she gave me the number to call them. I told her she would have to call. I also asked about the shore power cord and she said that it was at a friends house and she would need time to go find it. Just seems like we keep getting setbacks and excuses. In her defense the shop did tell her she should have a signed contract before they de-winterize it so I wrote one up but haven't been able to get our schedules together to sign them. I did sign my copy and email it to her Thursday night. Just frustrating that we are now probably looking at at least the middle of August before we take possession. At that point there will likely be alot more boats hitting the market so part of me thinks about walking away and waiting until this seasons boats go up for sale.
I took care of the financing July 18th so we have been waiting since then with no progress. My surveyor was out of town until this past Thursday so I understand we couldn't have got it done sooner but they had all week to get the boat ready.
Is this normal? We paid cash for our last boat with no survey and transferred it 3 days after we first looked at it. Are my expectations too high? We both like this boat and after 6 weeks we looked at about every boat within 100 miles radius and nothing close to what we want. Just frustrating knowing that by the time we get this deal done we will have about 3 or 4 weeks of use before we pull it for the winter. We normally pulled ours about mid September or so but could stay in till end of September at the latest. We store in an underground cave so to get a spot we need to be in a little early.
