Just a rant - uninsured motorist and why people suck

While I hear you, that's not 100% true. You can sue him in small claims. Whether it's worth your time is another question.
Yep. Called my attorney. His advice is to forget that option as well. Chances of collecting are zero and once again there is no recourse if he loses but does not pay.
 
I mentioned some of this above, but since living in Charlotte, I have been rear ended 3 times - over a 20yr period, so not happening every day! One was a hit and run. A good Samaritan had the accident on video, so I was able to get the tag number. Police did not do much, but they did use the tag to get the owners information and insurance. Turns out grandson took the car and grandma had no idea. Insurance tried to deny the claim, but luckily I had the video, sent it too them and of course there was no disputing it. My point is 3 rear end accidents, non my fault, and all three should not have even been driving that day! In many cases, you get in an accident these days, doesn't matter who's fault it is, your are in for a fight to get anything. Just crazy how many people drive around no license, no insurance nothing, just driving.

Have you seen them driving these days? There are no rules, fk everyone else. It's crazy on the road.

Isn't PA a no-fault insurance state? Based on your original post I had assumed it was not...but google says PA is indeed no-fault. So even if the driver that hit you had insurance, your insurance was still going to pay.

What are we missing? In no-fault states I think you can only sue for your deductible if uninjured, nothing more?
 
In Pa, the driver who causes the accident, if They have insurance, can be made to pay property damages. Typically we file with our carrier and they subrogate. This provides a path to be reimbursed for deductibles, rentals, sometimes diminished value, etc.
Each party, regardless of who is at fault, collects compensation such as lost wages and medical bills from their own respective insurers.
