Good idea TT................ you and Skip certainly have had your share of anchor incident this year. :wink:
 
I too, was once hit in the pulpit, and since my anchor was there, I won the battle. You may want to consider placing pulpits all around your boat in a battle formation, loaded with anchors of course. That should keep them off you. good Luck.

Like all the others, I am sure glad no one was injured. You would think that if the blow-boater was alone that they would know how to handle the boat under power!

On the positive side, you now have the excuse I don't have yet to get one of those pretty polished ss anchors. :wink:

:smt009 that is crazy!!!!.....Thank goodness no one was hurt! Was she drunk? I can't get over backing anything up without looking where your going (and a pristine 420DA is hard to miss).

I also am amazed at the number of jurisdictions we all cross over in the Greater Washington DC area.

Hope you are making progress on this one. I would avoid any suit under admrialty laws since the suit will be against the vessel as a litigant. Even if you get a judgment, the last thing you need is a lein against a derelict blowbote........what have you got if they gave you the boat?

There is enough here to make a project out of the operator of the boat. Assemble your repair budget and get her address and send her a registered letter demanding (be nice, but it is a demand letter) replayment for the damage. If she doesn't have the cash, then prepare a demand note for the damage and get her to sign it in front of a witness or notary public. If she makes payments, great, if not, file a UCC1 at the local court house and she will be done borrowing money or getting credit until you remove the UCC1.

By the way, I have a spare 45 lb Danforth I'll loan you if you need it!

Great advice as always. We are making slow and steady progress. I have the new anchor quote ($225) and am waiting on the written estimate to correct the other damage. As we were loading up yesterday morning to head north to DC for the weekend (pre BIH trip shakeout cruise) the Case Officer from the Maryland Department of Natural Resources Police stopped by Quantico Marina in his Whaler. We chatted for a while, then I took him up to the bow to see the damage. He just shook his head at the force required to bend the flukes on my plow. Nice guy. He has a son about the age of my oldest so we BS'd about soccer, kid's movies, etc.

Saturday was a hot one so I hooked him up with a bottle of ice water on his way out. I also called Ms. Ragbote last week; she seems ready to pay, though she is clearly nervous about cost. I told her that we were very lucky that my wife and kids were unhurt, and I wanted my boat made right. I think she gets it. The Police Officer is finishing his report now. He mentioned that Ms. Ragbote has failed to return his calls. Bad on her.

So more to follow. I think this will get resolved favorably.

I ended up installing a new Shur Flo fresh water pump on Friday afternoon, and as I was buttoning her up I lost my balance and grabbed the stainless steel drink holder on the aft end of the cockpit, starboard side, to avoid a fall into the drink. Broke a mounting bolt off the drink holder, of course. Man but is that sucker hard to get to...I had to empty out the transom locker and crawl inside the locker to get to the mounting hardware for the drink holder. I was up until 10:30 friday night drilling and tapping out the broken bolt and cutting threads to install a new mounting bolt; then back into the transom trunk on Satruday morning to put it back together.

Glad the boys were not there when I broke the danged thing on Friday afternoon. I said a few unfortunate words.

I will post more on the water pump swapout and drink holder triage later this week. A two advil affair.

By way of a quick update: I have kept in cordial contact with my sailboting friend, and the Maryland Department of Natural Resources Police Officer handling our case.

The estimates are in.

New anchor davit for an 03 420DA: (she bent mine) $465
New anchor " " $225
Gel coat repair, re-bedding the new davit, and repair of any gel or structural damage under the davit: Just over $1,000

Total: ~$1770 with all materials and tax. Ms. Ragboter seems relieved on the phone tonight. I will next send her a registered letter with photos of the damage, an eyewitness statement attesting to her failure to maintain proper watch and maneuver astern safely, etc. and a copy of the Md Natural Resources Police rport, which I have yet to see in final form.

She indicated tonight a desire to pay in a couple installments. I am thinking max of three pmnts, cashier's check or money order, no personal checks of any sort, maximum payment duration not to exceed six weeks, assuming she gets paid every two weeks.

What am I missing? Is it bad form to put ragbote silhouettes with red slashes through them on the side of my arch? Four more and I will be an Ace, in fighter pilot terms.
Not bad for a retired Army ground pounder.

If you decide to take payments on this, have your ragbote queen execute a demand note for the whole balance with you as the payee. State clearly in the note any terms like 3 equal payments to be received by (not mailed) note holder on 8/1/07, 9/1/07, and 10/1/07 and that any unpaid balance after 10/2/07 will be due and payable upon demand and will bear interest at the rate of XXX% per month or portion thereof, to be compounded daily.

There are several reasons for this that we can talk about off-line, but it will give you some leverage if you need it. Everyone always has the best intentions, but for some reason, "stuff" tends to get in the way of best intentions.

If she asks why you need to be so official and formal you can tell her:

a. I'm retired from the military and I just think "formal"
b. make up something like my insurance co. says either I get a note or I file a claim now
c. so I can hound your worthless butt 'til doomsday
d. all of the above.

Yeah, a demand note / promisary note is a good way to go.

Once you do that, it doesn't matter if she pays you via personal check, cash, or in Gasoline. All that counts is if she paid you or not.
