HELP..... 6.2 > 5.7 Dealer Mistake

Hi Guys,

I bought a 2004 Sea ray 260 from New Wave Yacht Dealer in MA in January. I have their add and it states the engine is a 6.2 MPI. Since it was cold and freezing ice we never did a sea trial but made the deal. Part of the deal one of the owners was suppose to come to NJ on the day of lunching the boat to make sure all gauges electronics engine and etc works fine.

Since its a long way from MA to NJ i told the guys to pay for a authorized sea ray mechanics to inspect everything and if they say boat is in good conditions and everything works than i dont need them to come and they are taking care of the bill. .

NOW . . . Remember the AD said 6.2 MPI and i have emails from the dealers stating its a 6.2 i have all docs says its 6.2 BUT in reality there is a 5.7 350 MAG.

Boat is in absolute perfect condition engine is as well, but i am not happy i got played out does anyone have any recommendations on what i should do ? Should i ask for some refund from the dealer and if so how much?

What does your signed bill of sale say?
 
Wouldn't Caveat Emptor apply here? Does the bill of sale state sold as is, or is their a warranty?
 
I wouldn't say there is a warranty although like i said they were suppose to come to NJ to warranty that all is working fine and if something is not working right they are taking care of the issue at their expense. BUT their Add says 6.2

I would't say bait n switch i think its just the wrong information was given to me and i am trying to find out what are my options?
 
They're going to tell you it was a type-o and the boat was priced with the correct engine in mind. Will be interesting to see what, if anything, they are willing to do.
 
if you like the boat and it performs well with the 5.7 MAG then you could do some research to see the cost of the boat when new with both engines...the upgraded 6.2 MPI would likely have cost more so you could ask for the upgrade engine cost back from the dealer.....

Sounds like another "I don't need no stinkin' survey" story. My guess is, the broker has some disclaimer verbiage in the paperwork that absolves them of "inadvertent misrepresentation"
 
When I bought my Crownline 262 (2002) new, the upgrade to the 6.2L Mag Horizon was bout $2800. Very similar boat as the 260DA.

I am sure New Wave Yachts won't be happy with my news just got off the phone with the dealr and:

-False engine details
-engine will not pump water from out drive
-hot water tank has a hole b/c of not being winterized properly
-steering cable needs replacement
 
I think I would be fine with the 350Mag in that boat, BUT, if it was advertised and sold as having a 6.2, then you didn't get what you were paying for. If you are happy with the boat otherwise, hopefully they can work something out - refund some $$ or pay for some service, some type of compensation. I have no idea what the cost difference would have been for the 6.2 when that boat was new. But on the used values I doubt there is much if any difference in the values. You will never know if the dealer would have priced it differently with a 350Mag vs 6.2.

Back then is was only a 20HP gain when you upgraded to the 6.2, so $2,800 seems like a lot of $$.

well i just with the guys who do all service on my boats they said about $3000 to $4000 difference.
 
The upgrade was to move to closed cooling too - not just for the extra HP.
