There is also a duty to retreat. In most (if not all) states this does not apply to the home due to the Castle Doctrine. If you are out in public and somebody pulls a gun and points it at you and there is an exit for you then there may be an issue with justification if you choose to return fire. Law enforcement is not bound by the duty to retreat. In most cases it will come down to how well you can articulate why you were not able to retreat.

Not in Michigan there isnt. No duty to retreat here. If you life is in danger you have every right to defend your life by any means necessary. Stand your Ground just like Florida.
 
You have to think about what your defending, property or life. One allows for lethal force the other doesn't.

If you catch some guy in your garage stealing your lawnmower the law doesn't allow lethal force. If when you catch him he pulls a gun on you, then the law does allow for lethal force. At that point you're defending life and not property.

In each state's laws that I've read the concept of 'reasonable force' is present.
If this was only some guy trying to steal a lawnmower. They are out for complete destruction. And if you stand in their way they will beat you to death.
 
Getting a little more like an eight after a friend saw a since removed FB post that said something close to “we are going to break in to White folks house and take back what is ours”. That is a little unsettling. Hard to imagine that coming to fruition in our rural area but I can see that happening in areas just out side of downtown in mid to large size cities.

I believe that would turn out very poorly for any group that attempted that. They would go down in a hail of gunfire. I made a wrong turn there once and had three SS vehicles there in seconds giving me an escort outta there. That’s one house they don’t mess around at.

Id gladly open my door and invite them in. Then I’d lock it behind them.

I'd have to say a solid 10. The advantages to living on an island:) The problem is that I have to drive through Detroit to get to work. That's where I have concerns.
 
I'm not going to try and start the classic Canada vs US debate. Both countries have their pro's and con's.. But man I cannot believe what is going on down there. Hope you are all staying safe.

The border is closed ..... I have friends trying to escape Ontario By boat and come to all open ohio and can’t... hopefully by end of June

Here? a 10. back in Va, a 5 if I was still there. The road I used to drive to get to work is supposedly barricaded as protestors plan on taking it up at Lee Davis High School. My daughter would be graduating from there if we still lived there. DA1A, can you confirm? I would not want to be in Richmond right now.
 
You still seem to think like a police officer. You see things one way...your way. Phasma, I am thinking like a cop because that's who would be investigation the situation if you shot someone. I've spent enough hours sitting in court listening to defense attorneys tear a case apart because the fear for life was not clearly articulated. I clearly stated the property I referred to was my home. Like most police officers you appear to use a previously unclarified comment to trip up the person of interest and advance your agenda. I have no agenda here other than to try to clarify what Michigan law is. BOTH the entering your home AND the fear for your life must be present. I continued to clarify my comments, sent you a link to the Michigan law yet you continue your barrage of comments and criticisms concerning my ability to present my case. You picked my every word apart in order to argue to be right.Trust me when I say that I am not trying to be right. I have no dog in this hunt. If you feel so strongly that I am wrong in my position feel free to argue your point with the Michigan legislature. I am telling you what the law is. There have been many incidence that has generated case law. I am just glad that we have the court system that at least partially protects us from overzeolous police officers up to and including those that would do us harm or violate our rights. You and I are on the same page here. In my career as a cop I encountered overzealous cops and did my best to stop what I felt were the overzealous acts. I believe I covered all of your objections when I pointed out that if a perp were to break into my home and I was in fear of my life I would be justified in the state of Michigan. Yes, you would be but the fear for your life must be present.

I respect your position and your thoughts about using deadly force. Having been in that situation once where I had to use deadly force, be aware that if you do kill someone, no matter how justfied it was, there are many mental issues you will have to deal with after all the smoke has cleared. I was a cop who trained other cops from across the state in the use of deadly force and was well aware of the psychological trauma events that follow the taking of a person's life. They ain't fun, believe me. I hope you never have to find out the hard way what they are.

Agreed. I am never advocating or hoping for a situation like that. I was an ALS as well as Critical care paramedic for 25 years. Ive seen more than my fair share of shootings. Most of them civilian shooters but a few PD. Ive seen first hand what it does to an officer. Ive also sat on the bar stool next to them and listened as their lives and professions crumbled around them. I think its almost better to be the one getting shot as you dont have to live with the memory.

I am glad we debated our way through this sensitive topic GFC......now......its happy hour somewhere. On to the next world changing topic.
 
How about this: For the first time in over a decade we launched astronauts from a rocket on US soil, they connected with the space station and the missing is going well.

Now THAT is something to be very proud of, but we hear little of their successes with all this other crap going on.
 
It is a truly amazing accomplishment worthy of major accolades. We are like little kittens in our attention span.
 
My son and I were glued to the TV watching the launch. I was just a hair older than he is now when Challenger fell from the sky, so it was a cool Dad moment.

My Squadron Mate Mike Smith was the Challenger Pilot. I was there watching his launch. It was not a cool moment for Susan and me...just sayin'...
 
Well, we've been told by the marina staff to not go outside the gated areas at night.....so not very safe. I personally carry, so for myself, around a 6-7...however my wife and kids on their own, about a two.

We did have a woman struck by a bullet just outside the marina last week.
